GENERAL TERMS AND CONDITIONS

1. Acceptance of Agreement

The present General Terms and Conditions regulate the contractual relationship for the provision of services according to the selected service offer between the Green Card Group LLC, with registered office in 1309 Coffeen Avenue, STE 1200, Sheridan, Wyoming 82801 and the customer.

THIS AGREEMENT CONTAINS WARRANTY DISCLAIMER AND OTHER PROVISIONS THAT LIMIT OUR LIABILITY TO YOU. PLEASE READ THESE TERMS CAREFULLY AND ENTIRELY BECAUSE BY BROWSERING OUR WEBSITE AND/OR BROWSERING USING OUR SERVICES, YOU ARE AGREEING TO BE BOUND BY THESE TERMS. IF YOU DO NOT AGREE TO ALL THE TERMS SET FORTH HEREIN, PLEASE IMMEDIATELY LEAVE AND DISCONTINUE USING OUR WEBSITE.

2. Scope

The general terms and conditions apply to the entire range of services and products offered by Green Card Group LLC, which are distributed via the website at www.usa-esta-online.com.

3. Terms of Participation

3.1. The general terms and conditions are valid at the time the contract is concluded and apply between us and the customer when using our services and submitting an ESTA application via the website www.usa-esta-online.com.
3.2. Supplementary terms and conditions of the customer that are not contained in the general terms and conditions are not recognized.

4. Registration and conclusion of contract

4.1. Our offers on the Internet are not binding.
4.2. With the submission of an ESTA application form digitally via the website www.usa-esta-online.com, the customer confirms the offer after entering their data by selecting the desired service pack.
4.3. The registration process can be canceled at any time before the customer has made a payment.
4.4. As soon as the customer has submitted his data after completing the payment, he will receive a registration confirmation via e-mail. This confirms the customer's order to submit an ESTA application as part of the selected service package.
4.5. This registration confirmation is only intended to inform the customer that the order has been received.
4.6. A contract shall only be concluded when we confirm the order in writing or by processing the application form.
4.7. The customer is responsible for ensuring his eligibility to travel to the United States under the Visa Waiver Program. For countries of origin that are excluded from the Visa Waiver Program, please visit countries.
4.8. If the customer is not eligible to travel under the Visa Waiver Program, we advise the customer to apply for a US visa at the nearest U.S. embassy or consulate instead.
4.9. Should the US authorities change the terms and conditions to travel under the Visa Waiver Program during the application period, the customer will be informed of the changed conditions as soon as possible.
4.10. The text of the contract shall be stored by us.

5. Service

5.1. Green Card Group LLC is not affiliated with any U.S. government agency.
5.2. Green Card Group LLC offers its customers a paid service for submitting their ESTA application and provides assistance in applying for a US visa. The customer has the opportunity to apply for an ESTA on the official government website esta.cbp.dhs.gov/.
5.3. Green Card Group LLC does not guarantee approval of the customer’s ESTA application.
5.4. The customer acknowledges that an approved ESTA application does guarantee entry into the United States, as a U.S. Customs and Border Protection Officer has final authority to permit or deny entry. Green Card Group LLC cannot be held liable if the customer is denied entry into the United States.
5.5. The scope of the services we provide depends on the service package selected: "Standard ESTA” or “High Priority ESTA”.
5.6. The submission of an ESTA application is only possible if we receive an application with complete information (including additional requested documents).
5.7. Green Card Group LLC cannot be held liable for incorrect information and invalid data submitted by the customer.
5.8. Changes to customer data can only be made before the application is submitted. In order to ensure that the customer's application can be submitted in a timely manner, it is the customer's responsibility to verify the accuracy of their data. The customer has the possibility to check their data on the application overview page before submitting the application.
5.9. The customer can notify us about a change in his personal data in writing. (by email to support@usa-esta-online.com).
5.10. Changes are only considered accepted once the customer has received an e-mail confirming these changes.
5.11. As soon as the customers ESTA status changes, he will be informed via e-mail.

6. Right of Withdrawal

6.1. The customer waives his right to a refund if he cancels the contract. Green Card Group LLC may offer a partial refund in case it has not yet started to perform the service.
6.2. Customers who have selected the “High priority” service package are entitled to a refund if their ESTA application is denied. The refund amount is the amount paid minus the government processing fee of 24 dollars. The right for a refund does not apply if the customer withdraws from the contract by his own decision.
6.3. Refunds are not available if the customer has previously been denied entry into the United States or if their ESTA application has been denied before.
6.4. If the official services for providing the ESTA travel authorization are no longer available due to an unforeseen serious event (e.g. war, embargo, failure of the electronic infrastructure, other technological restrictions, changes in the relevant laws or the cessation of the Visa Waiver Program), both contracting parties can withdraw from the contract by means of a written notification. In the case of cancellation, the customer will be refunded the amount paid minus the government processing fee of 24 dollars.

7. Customer Obligations

7.1. The customer confirms that the information provided is complete and correct. We do not check the accuracy of the data submitted by the customer.
7.2. If the data submitted does not meet the requirements of the Visa Waiver Program, the customer will be informed. The customer is obliged to submit the requested information immediately.
7.3. In the event of a change in the information required for registration, the customer is obliged to provide us with all the requested documents in due time and in the required form.
7.4. The customer is obliged to immediately notify us of any changes to his personal data that are relevant to the registration.
7.5. If the customer violates his contractual obligations, we are entitled to withdraw from the contract and/or to demand compensation for non-performance.

8. Costs

8.1. The prices listed on our website are the binding gross price.
8.2. The prices include the statutory value-added tax as well as all additional costs incurred for the processing of the customer order.
8.3. The prices include the government processing fee.

9. Payment

9.1. The service fee is due for payment after the entry form has been processed.
9.2. The customer can choose between two payment methods: Credit Card or PayPal.
9.3. If we do not receive the service fee within 14 days of processing the entry form, the customer is in default of payment. In this case, we are entitled to demand compensation for non-performance and/or to withdraw from the contract. We reserve the right to withhold performance until full payment has been made. Offsetting is only possible if the customer's counterclaims have been legally established or recognized by us.

10. Limitation of Liability

10.1. Any liability of Green Card Group LLC is excluded in case of a partial or total impossibility of providing the service due to external reasons (e.g. in the event of catastrophes, unforeseeable circumstances, in the event of a fault on the part of third parties or the customer, events such as war, embargoes, failure of the electronic infrastructure, other technological restrictions, changes in the relevant laws or the termination of the Visa Waiver Program).
10.2. We are only liable for other damages in the event of breaches of contractual obligations.
10.3. We are not responsible for the content of other websites linked on our website.
10.4. We have no control over changes in applicable laws governing the Visa Waiver Program and are not responsible in case the customers ESTA travel authorization is denied or if the customer is denied entry into the United States.

11. Links to Other Websites

Our Website may contain links to third-party websites. Inclusion of links for any website on our Website does not mean that we endorse, guarantee or recommend the services, information and content of such third-party websites.

12. Linking to Our Website

You may provide links to our website if you do not remove or obscure any portion of our website by framing, your website does not contain illegal or pornographic activity, and you immediately cease providing links to our website upon our request.

13. Disclaimer

The material on our websites and on linked third-party websites is for informational purposes only and does not constitute legal advice.

14. Errors and Changes on our Website

We do not represent or warrant the information available on our Websites will be correct, accurate, timely, or reliable. We reserve the right to change any content used or contained in our Website or Products at any time without notice.

15. Privacy

15.1. By signing up, the customer expressly authorizes us to process the personal, including sensitive, data necessary for the fulfillment of this contract. The personal data that we obtain may only be used for the execution of this contract. Any other use is therefore excluded.
15.2. Customer data will be passed on to the US authorities for the execution of the order. We would like to point out that the responsible US authority is not subject to the high data protection standards of the European Union.
15.3. The customer can request information about his stored data and their correction or deletion at any time. Inquiries of this nature should be directed to: support@usa-esta-online.com

16. Exclusive Venue and Governing Law

16.1. The District Court of Sheridan, Wyoming, will have exclusive jurisdiction for any dispute regarding the interpretation, execution and termination of the order.
16.2. Anything not provided for in these GTC, express reference is made to the applicable legislation.

17. General Provisions

17.1. The eventual partial or total ineffectiveness and/or nullity of one or more clauses of these GTC shall not affect the other clauses, which shall be considered fully valid and effective.
17.2. These General Terms and Conditions replace any other previous agreement that may have existed between us and the customer that had the same subject. Regulations or supplements that deviate from these General Terms and Conditions are only valid and effective if they are expressly confirmed in writing by both parties.
